1. Legal Notice and Information and its Acceptance

This legal notice and information (hereinafter, the “Legal Notice”) regulates the use of the service of the Internet portals “www.artsurfcamp.com”, “www.artsurfcamp.co.uk”, “www.artsurfcamp.de”, “www.artsurfcamp.it” (hereinafter, the “Portal”) that Arsurfcamp.com (hereinafter, “ARTSURFCAMP”) makes available to Internet users.

The use of the Portal attributes the condition of user of the Portal (hereinafter, the “User”) and implies the full and unreserved acceptance of each and every one of the provisions included in this Legal Notice in the version published by ARTSURFCAMP at the very moment the User accesses the Portal. Consequently, the User must carefully read this Legal Notice on each of the occasions in which they intend to use the Portal, as it may undergo modifications.

The use of certain services offered to Users through the Portal is subject to its own specific conditions (hereinafter, the “Particular Conditions”) which, depending on the case, replace, complete, and/or modify this Legal Notice. Therefore, prior to the use of said services, the User must also carefully read the corresponding Particular Conditions.

Likewise, the use of the Portal is equally subject to all notices, regulations of use, and instructions made known to the User by ARTSURFCAMP that replace, complete, and/or modify this Legal Notice.

2. Assignment of image rights

Students authorize Art Surfcamp to assign, broadcast, distribute, execute, and display images or videos of my child/ward performing the camp’s own activities on the website www.artsurfcamp.com and its social networks. In accordance with the provisions of the GDPR (RGPD) and LOPDGDD, in writing or via electronic means, in exercise of the rights recognized in the aforementioned legislation, you may exercise your right to revoke the assignment of the aforementioned images, at any time, at administración@artsurfcamp.com.

3. Object

Through the Portal, ARTSURFCAMP provides Users with access to and the use of various services and contents (hereinafter, the “Services”) made available by ARTSURFCAMP or by third parties.

4. Conditions of access and use of the portal

4.1. Free nature of access and use of the Portal

The provision of the Services by ARTSURFCAMP is free of charge for Users. Notwithstanding the above, some of the Services provided by ARTSURFCAMP or by third parties through the Portal are subject to the payment of a price in the manner determined in the corresponding Particular Conditions.

4.2. User Registration

In general, the provision of services does not require prior subscription or registration of Users. However, ARTSURFCAMP conditions the use of some of the Services on the prior completion of the corresponding User registration, which is available for those who wish to register at https://www.artsurfcamp.com/. Likewise, ARTSURFCAMP makes available to Users some Services whose use requires the completion of additional registrations. Said registration shall be carried out in the manner expressly indicated in the service itself or in the Particular Conditions that regulate it.

4.3. Veracity of information

All information provided by the User through the Services must be truthful. For these purposes, the User guarantees the authenticity of all data communicated as a result of completing the forms necessary for the subscription of the Services. Likewise, it shall be the User’s responsibility to keep all information provided to ARTSURFCAMP permanently updated so that it responds, at all times, to the User’s real situation. In any case, the User shall be solely responsible for any false or inaccurate statements made and for the damages caused to ARTSURFCAMP or to third parties by the information provided.

4.4. Minors

To make use of the Services, minors must previously obtain permission from their parents, guardians, or legal representatives, who will be considered responsible for all acts performed by the minors in their charge. Full responsibility in determining the specific content and Services accessed by minors belongs to the adults in whose charge they are. As the Internet makes it possible to access content that may not be appropriate for minors, Users are informed that mechanisms exist, in particular computer filtering and blocking programs, which allow the limiting of available content and, although they are not infallible, they are especially useful for controlling and restricting the materials that minors can access.

4.5. Obligation to make correct use of the Portal and Services

The User agrees to use the Portal and the Services in accordance with the law, this Legal Notice, the Particular Conditions of certain Services and other notices, usage regulations and instructions made known to them, as well as with morality and generally accepted good customs and public order.

To this end, the User shall refrain from using any of the Services for illegal purposes or effects, prohibited in this Legal Notice, harmful to the rights and interests of third parties, or that in any way may damage, disable, overload, deteriorate or prevent the normal use of the Services, computer equipment or documents, files and all kinds of content stored on any computer equipment (hacking) of ARTSURFCAMP, other Users or any Internet user (hardware and software).

In particular, and by way of illustration only and not exhaustive, the User undertakes not to transmit, disseminate or make available to third parties information, data, content, messages, graphics, drawings, sound and/or image files, photographs, recordings, software and, in general, any kind of material that:

(a) in any way is contrary to, disparages or attacks the fundamental rights and public liberties recognized constitutionally, in international Treaties and in the rest of the legislation;

(b) induces, incites or promotes criminal, denigratory, defamatory, infamous, violent actions or, in general, those contrary to the law, morality and generally accepted good customs or public order;

(c) induces, incites or promotes discriminatory actions, attitudes or thoughts by reason of sex, race, religion, beliefs, age or condition;

(d) incorporates, makes available or allows access to criminal, violent, offensive, harmful, degrading products, elements, messages and/or services or, in general, those contrary to the law, morality and generally accepted good customs or public order;

(e) induces or may induce an unacceptable state of anxiety or fear;

(f) induces or incites involvement in dangerous, risky or harmful practices for health and psychological balance;

(g) is false, ambiguous, inaccurate, exaggerated or untimely, so that it induces or may induce error about its object or about the intentions or purposes of the communicator;

(h) is protected by any intellectual or industrial property rights belonging to third parties, without the User having previously obtained the necessary authorization from their owners to carry out the use they perform or intend to perform;

(i) violates the business secrets of third parties;

(j) is contrary to the right to honor, to personal and family privacy or to the own image of persons;

(k) in any way undermines the credit of ARTSURFCAMP or third parties;

(l) infringes the regulations on secrecy of communications;

(m) constitutes, where appropriate, unlawful, misleading or unfair advertising and, in general, constitutes unfair competition;

(n) incorporates viruses or other physical or electronic elements that may damage or prevent the normal operation of the network, the system or computer equipment (hardware and software) of ARTSURFCAMP or third parties or that may damage electronic documents and files stored on said computer equipment;

(o) causes, due to its characteristics (such as format, extension, etc.), difficulties in the normal operation of the Service;

(p) contains HTML tags other than those expressly authorized by ARTSURFCAMP.

4.6. Obligation to make correct use of the Contents

In accordance with the provisions of clause 4.5, the User agrees to use the contents made available to Users on the Portal, understanding these to include, but not be limited to, texts, photographs, graphics, images, icons, technology, software, links, and other audiovisual or sound content, as well as their graphic design and source codes (hereinafter, the “Contents”), in accordance with the law, this Legal Notice, the Particular Conditions of certain Services, and other notices, regulations of use, and instructions made known to them, as well as with morality and generally accepted good customs and public order, and, in particular, undertakes to refrain from:

(a) reproducing, copying, distributing, making available, or in any other way publicly communicating, transforming, or modifying the Contents, unless authorized by the holder of the corresponding rights or if it is legally permitted;

(b) deleting, manipulating, or in any way altering the “copyright” and other identifying data of the reservation of rights of ARTSURFCAMP or its holders, digital fingerprints, or any other technical means established for their recognition.

The User must refrain from obtaining and even attempting to obtain the Contents by using means or procedures other than those which, depending on the case, have been made available for this purpose or have been indicated for this purpose on the web pages where the Contents are located or, in general, those habitually used on the Internet for this purpose, provided they do not involve a risk of damage or disablement of the Portal, the Services, and/or the Contents.

4.7. Use of the Services offered on the Portal in accordance with the Anti-Spamming Policy of ARTSURFCAMP

The User undertakes to refrain from:

(i) collecting data for advertising purposes and sending advertising of any kind and communications for sales purposes or others of a commercial nature without prior request or consent;

(ii) sending any other unsolicited or previously consented messages to a plurality of persons;

(iii) sending chains of unsolicited or previously consented electronic messages;

(iv) using distribution lists that can be accessed through the Services for the performance of the activities mentioned in sections (i) to (iii) above; (v) making available to third parties, for any purpose, data collected from distribution lists.

Users or third parties harmed by the receipt of unsolicited messages addressed to a plurality of persons may communicate this to ARTSURFCAMP by sending a message to the following email address: info(a)artsurfcamp.com

4.8. Introduction of hyperlinks allowing access to the Portal’s web pages and Services

Users and, in general, those persons who intend to establish a hyperlink between their web page and the Portal (hereinafter, the “Hyperlink”) must comply with the following conditions:

(a) the Hyperlink will only allow access to the home-page or start page of the Portal, but may not reproduce them in any way;

(b) a frame shall not be created over the web pages of the Portal;

(c) no false, inaccurate, or incorrect statements or indications shall be made about ARTSURFCAMP, its directors, its employees, the web pages of the Portal, and the Services provided;

(d) it shall not be stated or implied that ARTSURFCAMP has authorized the Hyperlink or that it has supervised or assumed in any way the services offered or made available on the web page where the Hyperlink is established;

(e) with the exception of those signs that form part of the Hyperlink itself, the web page on which the Hyperlink is established shall not contain any trademark, commercial name, establishment sign, denomination, logo, slogan, or other distinctive signs belonging to ARTSURFCAMP; and

(f) the web page on which the Hyperlink is established shall not contain illegal information or content, contrary to morality and generally accepted good customs and public order, nor shall it contain content contrary to any third-party rights.

The establishment of the Hyperlink does not imply in any case the existence of relations between ARTSURFCAMP and the owner of the web page on which it is established, nor the acceptance and approval by ARTSURFCAMP of its contents or services.

5. Non-license

All trademarks, trade names, or distinctive signs of any kind appearing on the Portal are the property of ARTSURFCAMP or third parties, and it cannot be understood that the use of or access to the Portal and/or the Services attributes to the User any right over the aforementioned trademarks, trade names, and/or distinctive signs.

Likewise, the Contents are the intellectual property of ARTSURFCAMP or third parties, and none of the exploitation rights that exist or may exist over said Contents can be understood as assigned to the User, by virtue of what is established in this Legal Notice, beyond what is strictly necessary for the correct use of the Portal and the Services.

6. Exclusion of guarantees and liability

6.1. Exclusion of guarantees and liability for the functioning of the Portal and the Services

6.1.1. Availability and continuity, utility and fallibility

ARTSURFCAMP does not guarantee the availability and continuity of the functioning of the Portal and the Services. When reasonably possible, ARTSURFCAMP will provide prior warning of interruptions in the functioning of the Portal and the Services. ARTSURFCAMP also does not guarantee the utility of the Portal and the Services for carrying out any specific activity, nor its fallibility and, in particular, although not exclusively, that Users can effectively use the Portal and the Services, access the various web pages that make up the Portal or those from which the Services are provided.

ARTSURFCAMP EXCLUDES, TO THE FULL EXTENT PERMITTED BY THE LEGAL SYSTEM, ANY LIABILITY FOR DAMAGES OF ANY NATURE THAT MAY BE DUE TO THE LACK OF AVAILABILITY OR CONTINUITY OF THE FUNCTIONING OF THE PORTAL AND THE SERVICES, TO THE DEFRAUDATION OF THE UTILITY THAT USERS MAY HAVE ATTRIBUTED TO THE PORTAL AND THE SERVICES, TO THE FALLIBILITY OF THE PORTAL AND THE SERVICES, AND IN PARTICULAR, ALTHOUGH NOT EXCLUSIVELY, TO FAILURES IN ACCESS TO THE DIFFERENT WEB PAGES OF THE PORTAL OR TO THOSE FROM WHICH THE SERVICES ARE PROVIDED.

6.1.2. Privacy and security in the use of the Portal and the Services

ARTSURFCAMP does not guarantee the privacy and security of the use of the Portal and the Services and, in particular, does not guarantee that unauthorized third parties cannot have knowledge of the class, conditions, characteristics and circumstances of the use that Users make of the Portal and the Services.

ARTSURFCAMP EXCLUDES, TO THE FULL EXTENT PERMITTED BY THE LEGAL SYSTEM, ANY LIABILITY FOR DAMAGES OF ANY NATURE THAT MAY BE DUE TO THE KNOWLEDGE THAT UNAUTHORIZED THIRD PARTIES MAY HAVE OF THE CLASS, CONDITIONS, CHARACTERISTICS AND CIRCUMSTANCES OF THE USE THAT USERS MAKE OF THE PORTAL AND THE SERVICES.

6.2. Exclusion of guarantees and liability for the Contents

6.2.1. Quality

ARTSURFCAMP does not control or guarantee the absence of viruses or other elements in the Contents that may produce alterations in your computer system (software and hardware) or in the electronic documents and files stored in your computer system.

ARTSURFCAMP EXCLUDES, TO THE FULL EXTENT PERMITTED BY THE LEGAL SYSTEM, ANY LIABILITY FOR DAMAGES OF ANY NATURE THAT MAY BE DUE TO THE PRESENCE OF VIRUSES OR THE PRESENCE OF OTHER ELEMENTS IN THE CONTENTS THAT MAY PRODUCE ALTERATIONS IN THE COMPUTER SYSTEM, ELECTRONIC DOCUMENTS OR FILES OF THE USERS.

6.2.2. Legality, reliability and utility

ARTSURFCAMP does not guarantee the legality, reliability and utility of the Contents.

ARTSURFCAMP EXCLUDES, TO THE FULL EXTENT PERMITTED BY THE LEGAL SYSTEM, ANY LIABILITY FOR DAMAGES OF ANY NATURE THAT MAY BE DUE TO THE TRANSMISSION, DISSEMINATION, STORAGE, AVAILABILITY, RECEPTION, OBTAINING OR ACCESS TO THE CONTENTS, AND IN PARTICULAR, ALTHOUGH NOT EXCLUSIVELY, FOR DAMAGES THAT MAY BE DUE TO:

(A) BREACH OF THE LAW, MORALITY AND GENERALLY ACCEPTED GOOD CUSTOMS OR PUBLIC ORDER AS A CONSEQUENCE OF THE TRANSMISSION, DISSEMINATION, STORAGE, AVAILABILITY, RECEPTION, OBTAINING OR ACCESS TO THE CONTENTS;

(B) INFRINGEMENT OF INTELLECTUAL AND INDUSTRIAL PROPERTY RIGHTS, BUSINESS SECRETS, CONTRACTUAL COMMITMENTS OF ANY KIND, RIGHTS TO HONOR, TO PERSONAL AND FAMILY PRIVACY AND TO THE IMAGE OF PERSONS, PROPERTY RIGHTS AND ALL OTHER NATURE BELONGING TO A THIRD PARTY AS A CONSEQUENCE OF THE TRANSMISSION, DISSEMINATION, STORAGE, AVAILABILITY, RECEPTION, OBTAINING OR ACCESS TO THE CONTENTS;

(C) THE PERFORMANCE OF ACTS OF UNFAIR COMPETITION AND UNLAWFUL ADVERTISING AS A CONSEQUENCE OF THE TRANSMISSION, DISSEMINATION, STORAGE, AVAILABILITY, RECEPTION, OBTAINING OR ACCESS TO THE CONTENTS;

(D) THE LACK OF TRUTHFULNESS, ACCURACY, EXHAUSTIVENESS, RELEVANCE AND/OR TIMELINESS OF THE CONTENTS;

(E) INADEQUACY FOR ANY KIND OF PURPOSE AND THE DEFRAUDATION OF THE EXPECTATIONS GENERATED BY THE CONTENTS;

(F) NON-COMPLIANCE, DELAY IN COMPLIANCE, DEFECTIVE COMPLIANCE OR TERMINATION FOR ANY CAUSE OF OBLIGATIONS CONTRACTED BY THIRD PARTIES AND CONTRACTS MADE WITH THIRD PARTIES THROUGH OR BY REASON OF ACCESS TO THE CONTENTS;

(G) VICES AND DEFECTS OF ALL KINDS IN THE CONTENTS TRANSMITTED, DISSEMINATED, STORED, MADE AVAILABLE OR OTHERWISE TRANSMITTED OR MADE AVAILABLE, RECEIVED, OBTAINED OR ACCESSED THROUGH THE PORTAL OR THE SERVICES.

6.2.3. Truthfulness, accuracy, exhaustiveness and timeliness

ARTSURFCAMP does not guarantee the truthfulness, accuracy, exhaustiveness and timeliness of the Contents.

ARTSURFCAMP EXCLUDES, TO THE FULL EXTENT PERMITTED BY THE LEGAL SYSTEM, ANY LIABILITY FOR DAMAGES OF ANY NATURE THAT MAY BE DUE TO THE LACK OF TRUTHFULNESS, ACCURACY, EXHAUSTIVENESS AND/OR TIMELINESS OF THE CONTENTS.

6.3. Exclusion of guarantees and liability for services provided by third parties through the Portal

6.3.1. Quality

ARTSURFCAMP does not control or guarantee the absence of viruses or other elements in the services provided by third parties through the Portal that may produce alterations in your computer system (software and hardware) or in the electronic documents and files stored in your computer system.

ARTSURFCAMP EXCLUDES ANY LIABILITY FOR DAMAGES OF ANY NATURE THAT MAY BE DUE TO THE PRESENCE OF VIRUSES OR THE PRESENCE OF OTHER HARMFUL ELEMENTS IN THE SERVICES PROVIDED BY THIRD PARTIES THROUGH THE PORTAL THAT MAY PRODUCE ALTERATIONS IN THE COMPUTER SYSTEM, ELECTRONIC DOCUMENTS OR FILES OF THE USERS.

6.3.2. Legality, reliability and utility

ARTSURFCAMP does not guarantee the legality, reliability and utility of the services provided by third parties through the Portal.

ARTSURFCAMP EXCLUDES ANY LIABILITY FOR DAMAGES OF ANY NATURE THAT MAY BE DUE TO THE SERVICES PROVIDED BY THIRD PARTIES THROUGH THE PORTAL, AND IN PARTICULAR, ALTHOUGH NOT EXCLUSIVELY, FOR DAMAGES THAT MAY BE DUE TO:

(A) BREACH OF THE LAW, MORALITY AND GENERALLY ACCEPTED GOOD CUSTOMS OR PUBLIC ORDER AS A CONSEQUENCE OF THE PROVISION OF SERVICES BY THIRD PARTIES THROUGH THE PORTAL;

(B) INFRINGEMENT OF INTELLECTUAL AND INDUSTRIAL PROPERTY RIGHTS, BUSINESS SECRETS, CONTRACTUAL COMMITMENTS OF ANY KIND, RIGHTS TO HONOR, TO PERSONAL AND FAMILY PRIVACY AND TO THE IMAGE OF PERSONS, PROPERTY RIGHTS AND ALL OTHER NATURE BELONGING TO A THIRD PARTY AS A CONSEQUENCE OF THE PROVISION OF SERVICES BY THIRD PARTIES THROUGH THE PORTAL;

(C) THE PERFORMANCE OF ACTS OF UNFAIR COMPETITION AND UNLAWFUL ADVERTISING AS A CONSEQUENCE OF THE PROVISION OF SERVICES BY THIRD PARTIES THROUGH THE PORTAL;

(D) THE LACK OF TRUTHFULNESS, ACCURACY, EXHAUSTIVENESS, RELEVANCE AND/OR TIMELINESS OF THE CONTENTS TRANSMITTED, DISSEMINATED, STORED, RECEIVED, OBTAINED, MADE AVAILABLE OR ACCESSIBLE THROUGH THE SERVICES PROVIDED BY THIRD PARTIES THROUGH THE PORTAL;

(E) THE INADEQUACY FOR ANY KIND OF PURPOSE AND THE DEFRAUDATION OF THE EXPECTATIONS GENERATED BY THE SERVICES PROVIDED BY THIRD PARTIES THROUGH THE PORTAL;

(F) THE NON-COMPLIANCE, DELAY IN COMPLIANCE, DEFECTIVE COMPLIANCE OR TERMINATION FOR ANY CAUSE OF OBLIGATIONS CONTRACTED BY THIRD PARTIES AND CONTRACTS MADE WITH THIRD PARTIES IN RELATION TO OR BY REASON OF THE PROVISION OF SERVICES THROUGH THE PORTAL;

(G) VICES AND DEFECTS OF ALL KINDS IN THE SERVICES PROVIDED BY THIRD PARTIES THROUGH THE PORTAL.

6.4. Exclusion of guarantees and liability for information, content and services hosted outside the Portal

The Portal makes available to Users technical link devices (such as, among others, links, banners, buttons), directories and search tools that allow Users to access websites belonging to and/or managed by third parties (hereinafter, “Linked Sites”). The installation of these links, directories and search tools on the Portal has the sole purpose of facilitating Users’ search for and access to information, content and services available on the Internet.

The results of search tools are provided directly by third parties and are a consequence of the automatic operation of technical mechanisms, therefore ARTSURFCAMP cannot control and does not control those results and, in particular, that among them appear Internet sites whose contents may be illegal, contrary to morality or good customs or considered inappropriate for other reasons. In the event that a user considers that any of the sites included in the search results contains illegal activity or information and is interested in requesting the removal of the link, they may start the procedure provided for in the seventh clause of this Legal Notice.

ARTSURFCAMP does not offer or market, by itself or through third parties, the information, content and services available on the Linked Sites, nor does it previously control, approve, recommend, monitor or make them its own. The User, therefore, must exercise extreme caution in the evaluation and use of the information, content and services existing on the Linked Sites.

ARTSURFCAMP DOES NOT GUARANTEE NOR ASSUME ANY TYPE OF LIABILITY FOR DAMAGES OF ALL KINDS THAT MAY BE DUE TO:

(A) THE OPERATION, AVAILABILITY, ACCESSIBILITY OR CONTINUITY OF THE LINKED SITES;

(B) THE MAINTENANCE OF THE INFORMATION, CONTENT AND SERVICES EXISTING ON THE LINKED SITES;

(D) THE QUALITY, LEGALITY, RELIABILITY AND UTILITY OF THE INFORMATION, CONTENT AND SERVICES EXISTING ON THE LINKED SITES, IN THE SAME TERMS AND WITH THE SAME SCOPE PROVIDED IN GENERAL CONDITION 5.2 AND 5.3 REGARDING THE CONTENT AND SERVICES PROVIDED BY THIRD PARTIES THROUGH THE PORTAL.

6.5. Exclusion of guarantees and liability for the use of the Portal, Services and Content by Users

ARTSURFCAMP has no obligation to control and does not control the use that Users make of the Portal, Services and Content. In particular, ARTSURFCAMP does not guarantee that Users use the Portal, Services and Content in accordance with this Legal Notice and, where appropriate, with the Particular Conditions that may apply, nor that they do so in a diligent and prudent manner. ARTSURFCAMP also has no obligation to verify and does not verify the identity of Users, nor the truthfulness, validity, exhaustiveness and/or authenticity of the data that Users provide about themselves to other Users.

ARTSURFCAMP EXCLUDES ANY LIABILITY FOR DAMAGES OF ANY NATURE THAT COULD BE DUE TO THE USE OF THE SERVICES AND CONTENT BY USERS OR THAT MAY BE DUE TO THE LACK OF TRUTHFULNESS, VALIDITY, EXHAUSTIVENESS AND/OR AUTHENTICITY OF THE INFORMATION THAT USERS PROVIDE TO OTHER USERS ABOUT THEMSELVES AND, IN PARTICULAR, ALTHOUGH NOT EXCLUSIVELY, FOR DAMAGES OF ANY NATURE THAT MAY BE DUE TO THE IMPERSONATION OF A THIRD PARTY BY A USER IN ANY KIND OF COMMUNICATION MADE THROUGH THE PORTAL.

7. Protection of personal data

To use some of the Services, Users must previously provide ARTSURFCAMP with certain personal data (hereinafter, the “Personal Data”). ARTSURFCAMP will automatically process the Personal Data for the purposes, as well as under the conditions defined, in its Privacy Policy published at the URL www.artsurfcamp.com.

For the purposes of the provisions of Organic Law 15/1999, of December 13, on the Protection of Personal Data, and Law 34/2002, of July 11, on Information Society Services and Electronic Commerce, ARTSURFCAMP guarantees the confidentiality of its clients’ personal data. We inform you that your email address is part of a database managed under the responsibility of ARTSURFCAMP with the sole purpose of keeping you informed, either due to your status as a client or because you have requested commercial information at some point, or because you have authorized your data to appear in an automated commercial file.

It is the will of ARTSURFCAMP to avoid the deliberate sending of unsolicited email, for which reason you may at any time exercise your rights of access, rectification, cancellation, and opposition of your personal data by ordinary mail at C/ Valle Inclán 21 Bajo, Carballo – A Coruña, under the terms established in the LOPD. ARTSURFCAMP has adopted the legally required levels of security for the protection of personal data and seeks to install other additional technical means and measures of protection. However, the User must be aware that security measures on the Internet are not impregnable.

ARTSURFCAMP may use cookies when a User browses the sites and pages of the Portal. The cookies that may be used on the sites and pages of the Portal are associated only with the browser of a specific computer (an anonymous User), and do not themselves provide the User’s first and last names.

Thanks to cookies, it is possible for ARTSURFCAMP to recognize the browsers of registered Users after they have registered for the first time, without them having to register on each visit to access the areas and Services reserved exclusively for them.

The cookies used cannot read cookie files created by other providers. The User has the possibility to configure their browser to be warned on the screen of the reception of cookies and to prevent the installation of cookies on their hard drive. To use the Portal, it is not necessary for the User to allow the installation of cookies sent by ARTSURFCAMP, without prejudice to the fact that in such a case it will be necessary for the User to register each time they access a service that requires prior registration.

The cookies used on the sites and pages of the Portal may be served by ARTSURFCAMP, in which case they are served from the various servers operated by them, or from the servers of certain third parties that provide services to us and serve the cookies on behalf of ARTSURFCAMP (such as, for example, the cookies used to serve advertising or certain Content and that make the User view advertising or certain Content at a predetermined time, number of times, and form). As long as you have not activated the option that prevents the installation of cookies on your hard drive, the User may explore their hard drive following the instruction manual and help of their operating system (normally, in Windows operating systems you should consult the folder “C” (or the corresponding disk unit)/Windows/Cookies) to know in greater detail each server from which cookies are sent.

8. Procedure in case of performance of illegal activities

In the event that any User or a third party considers that there are facts or circumstances that reveal the illegal nature of the use of any Content and/or the performance of any activity on the web pages included in or accessible through the Portal, and, in particular, the violation of intellectual or industrial property rights (patents, industrial models and designs, trademarks and trade names, etc.) or other rights, they must send a notification to ARTSURFCAMP containing the following points:

(a) personal data of the claimant: name, address, telephone number, and email address;

(b) specification of the alleged illegal activity carried out on the Portal and, in particular, in the case of an alleged violation of rights, a precise and specific indication of the protected contents as well as their location on the web pages;

(d) in the event of violation of rights, a handwritten signature or equivalent, with the personal data of the owner of the rights allegedly infringed or of the person authorized to act in the name and on behalf of the latter;

(e) express, clear statement under the responsibility of the claimant that the information provided in the notification is accurate and of the illegal nature of the use of the contents or the performance of the activities described.

9. Notifications

All notifications and communications (hereinafter, the “Notifications”) by the User to ARTSURFCAMP will be considered effective, for all purposes, when addressed to the Customer Service in any of the following ways:

(a) Sending by post to the following address: C/Fomento nº 21 – 2º piso Local A, 15100 – Carballo (A Coruña);

(b) Sending by email to the following address: info(a)ARTSURFCAMP.COM. All Notifications by ARTSURFCAMP to the User will be considered effective, for all purposes, when carried out in any of the following ways:

(a) Sending by post to the User’s address when this has been previously made known to ARTSURFCAMP;

(b) Sending by email to any of the mailboxes that the User has or may have as part of any other service that ARTSURFCAMP provides to the User;

(c) Communication by means of a telephone call to the User’s phone number, when this has been previously made known to ARTSURFCAMP;

(d) By means of pop-up messages sent during the provision of the Services by ARTSURFCAMP to the User. In this sense, all Notifications made by ARTSURFCAMP to the User will be considered validly made if they have been carried out using the data and through the means previously indicated. For these purposes, the User states that all data provided by them are true and correct, and undertakes to communicate to ARTSURFCAMP all changes relating to notification data.

10. Withdrawal and suspension of services

ARTSURFCAMP may withdraw or suspend at any time and without prior notice the provision of the Services to those Users who fail to comply with the provisions of this Legal Notice.

11. Duration and termination

The provision of the Portal service and the other Services has, in principle, an indefinite duration. ARTSURFCAMP, nevertheless, is authorized to terminate or suspend the provision of the Portal service and/or any of the Services at any time, without prejudice to what may have been provided in this regard in the corresponding Particular Conditions. When reasonably possible, ARTSURFCAMP will provide prior warning of the termination or suspension of the provision of the Portal service and the other Services.

12. Applicable legislation

In any conflict regarding the interpretation or non-compliance with the provisions of this document, both parties, waiving their own jurisdiction if they have one, will submit to the jurisdiction of the Courts and Tribunals of A Coruña, and to the applicable Spanish legislation.
